We sell hours and phases of engineering, not a product in a box. That changes what a refund can reasonably mean, so it is worth being explicit instead of copying a policy written for an online shop.

• Unused money comes back. Advances for work not yet started, prepaid hours not yet worked, retainer periods not yet used.
• Work already delivered is billable, even if you decide to stop. Hours were spent and cannot be returned to us.
• Our mistakes are ours to fix, at no cost, and if we cannot fix them you are not paying for them.

Where a signed agreement sets out different terms for your project, that agreement wins.

Vendemos horas y fases de ingeniería, no un producto en una caja. Eso cambia lo que un reembolso puede significar razonablemente, así que conviene decirlo con claridad en vez de copiar una política escrita para una tienda en línea.

• El dinero no usado vuelve. Anticipos de trabajo aún no iniciado, horas prepagadas aún no trabajadas, periodos de iguala aún no consumidos.
• El trabajo ya entregado es facturable, aunque decidas parar. Las horas se gastaron y no se nos pueden devolver.
• Nuestros errores los arreglamos nosotros, sin costo, y si no podemos arreglarlos no los estás pagando.

Cuando un acuerdo firmado fije otros términos para tu proyecto, manda ese acuerdo.

Nothing to refund. It costs nothing, and it stays that way whether or not you hire us afterwards.

No hay nada que reembolsar. No cuesta nada, y sigue sin costar nada tanto si nos contratas después como si no.

Billed in arrears. We invoice for hours already worked, so there is rarely anything to return. Stop whenever you like; you pay for the hours up to that point and nothing more.

Disputed hours. If an entry on an invoice looks wrong, raise it within 15 days of the invoice date. We will show you the record. If we billed something we should not have, we credit it or refund it — your choice.

Prepaid blocks of hours, if we agree one: unused hours are refundable in full, pro rata, for six months from the date you paid. After six months they expire, because we held capacity for them. We will warn you before that happens rather than letting it lapse quietly.

Horas en disputa. Si una entrada de una factura te parece incorrecta, plantéala dentro de los 15 días siguientes a la fecha de la factura. Te enseñamos el registro. Si facturamos algo que no debíamos, lo abonamos o lo reembolsamos, como prefieras.

Bloques de horas prepagados, si acordamos alguno: las horas no usadas son reembolsables íntegras y a prorrata durante seis meses desde la fecha de pago. Pasados seis meses caducan, porque reservamos capacidad para ellas. Te avisaremos antes de que ocurra en lugar de dejar que venza en silencio.

Project work is split into phases, each with a closed price and usually an advance.

• You cancel before a phase starts: the advance for that phase is refunded in full. Every cent.
• You cancel while a phase is running: we bill the work genuinely completed up to that day and refund the rest of the advance. We will show you what was done, so the split is something you can check rather than something you have to trust.
• A completed phase is not refundable. It was delivered and it is yours, including the code and the documentation for it.
• We cancel: if we walk away for any reason other than your serious breach of the agreement, you get the full unused balance back and you keep everything produced so far. Us changing our mind should not cost you money.

El trabajo por proyecto se parte en fases, cada una con precio cerrado y normalmente un anticipo.

• Cancelas antes de que empiece una fase: el anticipo de esa fase se reembolsa íntegro. Hasta el último centavo.
• Cancelas con la fase en marcha: facturamos el trabajo realmente completado hasta ese día y reembolsamos el resto del anticipo. Te enseñamos lo hecho, para que el reparto sea algo que puedas comprobar y no algo en lo que tengas que confiar.
• Una fase terminada no es reembolsable. Se entregó y es tuya, incluido su código y su documentación.
• Cancelamos nosotros: si nos retiramos por cualquier motivo que no sea un incumplimiento grave tuyo, recibes íntegro el saldo no usado y te quedas con todo lo producido hasta ahí. Que cambiemos de idea no debería costarte dinero.

This one needs its own paragraph, because the deliverable is a document and documents cannot be handed back.

Before we deliver the written plan, the normal phase rules above apply. Once the plan is in your hands, it is not refundable — you have the investigation, the breakdown and the architecture, and you can take them to another firm and build from them. That is deliberate: the plan is yours to keep, and that is precisely why it is paid for.

If the plan turns out to be wrong in a way that is our fault, we rework it at no cost. That is a defect, not a refund question.

Cancel with 15 days' notice. Any prepaid period beyond the notice date is refunded pro rata.

We do not refund a period during which support was available to you and you simply did not use it. You were paying for someone to be there, and someone was there.

Se cancela con 15 días de aviso. Cualquier periodo prepagado más allá de la fecha de aviso se reembolsa a prorrata.

• Third-party costs. Cloud hosting, domains, licences, app store fees, paid APIs. That money went to someone else and we cannot recover it. Their refund rules are theirs.
• Bank and payment processor fees on the original payment. We refund the amount we received, not the amount the processor deducted before it reached us.
• Work completed and delivered, including a delivered analysis and design plan.
• Time lost to you. If a project stalls because we were waiting weeks on access or a decision, that reserved capacity is billable.

• Costos de terceros. Alojamiento en la nube, dominios, licencias, cuotas de tiendas de aplicaciones, APIs de pago. Ese dinero fue a parar a otro y no podemos recuperarlo. Sus reglas de reembolso son suyas.
• Comisiones bancarias y de pasarela del pago original. Reembolsamos el importe que recibimos, no el que la pasarela descontó antes de llegar a nosotros.
• El trabajo completado y entregado, incluido un plan de análisis y diseño ya entregado.
• El tiempo perdido por tu lado. Si un proyecto se estanca porque llevábamos semanas esperando un acceso o una decisión, esa capacidad reservada es facturable.

There is no form and no portal. Email jaw.nine@hotmail.com with:

• The invoice number or the payment date.
• What you are asking to be refunded.
• Why, in whatever words you like. You do not have to make a case.

Then:

• We acknowledge within 3 business days.
• We give you a decision, with the reasoning and the arithmetic, within 10 business days.
• If it is approved, the money is sent within 15 business days of that decision, by the same method you paid, to the same account.

If we disagree with you, you get a written explanation of why and the numbers behind it — not a template.

Si no te damos la razón, recibes una explicación escrita del porqué y los números que la sostienen, no una plantilla.

Talk to us first. A chargeback takes months, costs us a fee whatever the outcome, and produces a worse answer than an email would have.

We would rather refund something we are not strictly obliged to refund than argue with a payment processor about it. If you think we got it wrong, say so and we will look again.

Háblalo con nosotros primero. Un contracargo tarda meses, nos cuesta una comisión pase lo que pase y produce una respuesta peor que la que habría dado un correo.

Preferimos reembolsar algo a lo que no estamos estrictamente obligados antes que discutirlo con una pasarela de pago. Si crees que nos equivocamos, dilo y lo miramos otra vez.

Nothing on this page takes away a right you have by law.

If you are a consumer in Honduras, the Ley de Protección al Consumidor applies to you whatever this page says, and this policy is in addition to it, not instead of it. Most of our work is business to business, where the signed agreement carries more of the weight — but the distinction is decided by the law, not by us.
